The Village Experience, LLC, is defined to include its owners, agents, directors, officers, employees, representatives and affiliates, (collectively “Village Experience”). Village Experience does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. Village Experience is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party.
Without limitation, Village Experience is not responsible for any injury, illness, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, dangers associated with animals, marine life or vegetation of any sort, dangers incident to recreational activities such as scuba diving, snorkeling, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, exposure to infectious disease, lack of access to or quality of medical care, difficulty in evacuation in case of medical or other emergency, or for any other cause beyond the direct control of Village Experience.
ASSUMPTION OF RISK AND WAIVER
I am aware that travels such as those which I am undertaking involve hazardous activities, some in remote areas of the world, with a risk of illness, exposure to infectious disease, including but not limited to COVID-19, injury or death which may be caused by forces of nature, the negligence of Village Experience, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. I accept these risks and obligations and I fully assume the risks of travel and work in this type of environment. I fully and forever release and discharge The Village Experience, LLC and all other related, affiliated, associated or otherwise connected corporations, partnerships, individuals and other entities and all of their respective officers, directors, employees, contractors, agents, successors and assigns (collectively, the “Releasees”) from any and all costs (including, without limitation, actual legal costs), claims, demands, actions,
causes of action and liabilities whatsoever for any and all losses, damages, illness, death or injuries to persons or loss of property, which may be sustained by me in connection with or in any way relating to this trip, due to any cause or reason whatsoever including, without limitation, the reckless, willful or negligent actions or omissions of the Releasees or any other person or persons. If any portion of this Assumption of Risk and Waiver provision should in the future be deemed or held to be invalid or unenforceable, the Assumption of Risk and Waiver provision shall apply and be enforceable to the maximum extent allowed by law.
TRAVEL INSURANCE
Travel insurance is mandatory for all Village Experience travelers and must provide coverage against cancellation, personal accident, death, medical expenses and
emergency repatriation. We also strongly recommend that it covers curtailment, personal liability and loss of luggage and personal effects. Clients must be able to provide proof of insurance purchase and adequate coverage if requested by the group leader or company representative. The Client acknowledges that the cost of the tour does not include insurance, and that the Client is required to obtain separate coverage at an additional cost.
DISMISSAL FROM TRIP
The Village Experience retains the right to dismiss a TVE traveler for intimidating, threatening, or illegal behaviors or activities.
A. Illegal or Illicit Substance Use. Ingesting Illegal substances or participation in illegal activities endangers travelers and TVE partners and programs. Illegal drug use could result in dismissal from TVE trip and forfeiture of all costs, including reservations and tickets. Dismissal is left to the discretion of TVE staff. TVE is not responsible for any costs incurred as a result of participating in illegal activities, including, but not limited to, costs for medical care and court/incarceration proceedings. Any costs incurred by TVE as a result of these activities are the sole responsibility of traveler, and TVE will invoice traveler for immediate payment.
B. Intimidating or Threatening Behaviors. By engaging in intimidating or threatening behaviors, a traveler puts TVE staff, partners and other travelers in danger. TVE does not tolerate this behavior and retains the right to dismiss a traveler from a trip for engaging in this type of behavior. Dismissal is left to the discretion of TVE staff. TVE is not responsible for any costs incurred as a result, including, but not limited to, costs for medical care and court/incarceration proceedings. Any costs incurred by TVE as a result of these activities are the sole responsibility of traveler, and TVE will invoice traveler for immediate payment.
INTELLECTUAL PROPERTY
The Village Experience itineraries and programs are the intellectual property of TVE. Any replication of an itinerary or program, will be viewed as an infringement upon the intellectual property of TVE and will be pursued accordingly. Any interference on relationships with hotel partners, community partners, artisan partners, etc., will also be pursued under applicable laws.
KNOWING AND VOLUNTARY EXECUTION
I have carefully read this Agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and Village Experience, and its employees, officers and agents, and sign it of my own free will.
